Terms of Service for Castaway Holiday Apartments

Welcome to Castaway Holiday Apartments! By booking a stay with us, you agree to abide by the following Terms of Service. These terms apply to all bookings and interactions with our property,  so please read them carefully.

1. BOOKING AND PAYMENT

1.1 Booking Confirmation:
A booking is only confirmed once payment details have been provided and you have received a confirmation email from us.

1.2 Payment Policy:
We accept Visa, Mastercard and EFTPOS card payments. All payments must be made in full at check-in unless otherwise stated in these Terms of Service.

1.3 Rates and Charges:
Rates are subject to change and may vary depending on the booking date, season, and any applicable promotions. Additional charges, such as for damages or cleaning beyond standard requirements, may apply and will be notified as necessary.

1.4 Group Bookings (3 or More Apartments):
Bookings of three (3) or more apartments are subject to the following additional conditions:

  • A non-refundable deposit of $50 per apartment is required at the time of booking to secure the reservation.
  • The remaining balance is payable one (1) month prior to the check-in date. Payments are non-refundable in the event of cancellation.
  • Reducing the number of apartments or nights after the booking is confirmed may be treated as a cancellation and subject to the above conditions.
  • While every effort will be made to accommodate requests for specific apartments or locations, apartment numbers and locations cannot be guaranteed and may be subject to change. Management reserves the right to allocate or reassign apartments as required for operational purposes.

1.5 Payment Authorisation and Chargebacks:
By providing payment details and confirming a booking, the guest authorises Castaway Holiday Apartments to charge the nominated payment method for any amounts payable under these Terms of Service, including accommodation charges, cancellation fees, damages, or additional cleaning if applicable. Guests agree not to initiate a chargeback or payment dispute with their financial institution for charges that are consistent with these Terms of Service.

2.  CANCELLATION AND REFUND POLICY (Exluding Group Bookings – Refer 1.4)

2.1a Cancellations pertaining to Direct Bookings:

There is a 48-hour cancellation policy whereby no charge is made to the credit card providing we are given a minimum of 48 hours’ notice of cancellation or amendment prior to the check-in date.

  • Less than 48 hours’ notice prior to check-in date incurs a charge equivalent to one night’s stay.
  • Less than 24 hours’ notice prior to check-in date incurs the full cost of the booking.

All cancellations must be advised by email to info@castawaystrahan.com.au from the guest. Our confirmation of cancellation will then be sent to the guest for their records in case of dispute.

2.1b Cancellations pertaining to Bookings through Third Parties:

Please refer to the Third Parties’ Terms and Conditions.

2.2 Changes to Bookings:
Any changes to your booking must be requested at least 2 days prior to your check-in date and are subject to availability and management approval.

2.3 No-Show Policy:
Failure to check-in on the scheduled arrival date without prior notice may result in the cancellation of the reservation without refund.

3.  CHECK-IN AND CHECK-OUT

3.1 Check-In:
Check-in is available from 2:00pm on your arrival date. Early check-ins are subject to availability and may incur additional fees.

For group bookings of three (3) or more apartments, check-in may occasionally be slightly later depending on the number of apartments requiring cleaning that day. Every effort will be made to have apartments ready to our usual high standards as soon as possible.

3.2 Check-Out:
Check-out time is 10:00am on your departure date, unless otherwise specified.

For group bookings of three (3) or more apartments, check-out is 9:00am to allow sufficient time to prepare apartments for incoming guests.

3.3 Identification Requirements:
Guests may be asked to provide identification upon check-in to confirm the booking.

4.  GUEST RESPONSIBILITIES

4.1 Respecting Property and Other Guests:
Guests are expected to respect Castaway Holiday Apartments’ property, staff, and other guests. Any damage, excessive noise, or disruptive behaviour may result in termination of your stay without refund.

4.2 Maximum Occupancy:
Each apartment has a maximum occupancy of 4 people, which must be adhered to unless otherwise approved by management.

4.3 Smoking and Pets:
All apartments are non-smoking. Any evidence of smoking in the apartments may result in cleaning fees. Pets are not permitted.

4.4 Group Behaviour:
Guests travelling as part of a group booking are asked to be mindful of other guests staying at the property. Excessive noise, parties, or disruptive behaviour are not permitted. Management reserves the right to request that behaviour be modified or, in extreme circumstances, terminate a stay without refund if the comfort of other guests or the property is compromised.

5.  LIABILITY AND DAMAGES

5.1 Damage to Property:
Any damages to property, furniture, or fixtures during your stay will be charged to the payment method on file or requested as an additional payment.

5.2 Group Booking Liability:
For group bookings, the person making the booking is responsible for ensuring all guests comply with these Terms of Service. Any damage, loss, or excessive cleaning required across one or more apartments as a result of the group booking may be charged to the booking holder.

5.3 Guest Liability:
Castaway Holiday Apartments is not liable for personal injury, damage, or loss of personal belongings incurred during your stay, except as required by law.

5.4 Force Majeure:
We are not liable for events outside our control that may impact your stay, such as natural disasters, travel disruptions, or government regulations. In such cases, we will work with you to reschedule or modify your booking as needed.

6.  PRIVACY

Your personal information is managed in accordance with our Privacy Policy, which outlines how we collect, use, and protect your data. By staying with us, you agree to this policy.

7.  CODE OF CONDUCT

7.1 Compliance with Laws and Policies:
Guests must comply with all local laws, as well as any policies set by Castaway Holiday Apartments, during their stay.

7.2 Health and Safety Compliance:
Guests are required to observe any health and safety guidelines, as mandated by local authorities.

8.  AUSTRALIAN CONSUMER LAW

Nothing in these Terms of Service excludes, restricts, or modifies any rights or remedies that guests may have under the Australian Consumer Law or other applicable legislation, which cannot be excluded or limited. Where permitted by law, Castaway Holiday Apartments’ liability for any breach of a non-excludable guarantee is limited to the resupply of the accommodation or the cost of having the accommodation supplied again.

9.  AMENDMENTS TO TERMS

We reserve the right to update or modify these Terms of Service at any time. Any changes will be posted on our website and, where applicable, communicated to you prior to your stay.
